Im Mittelpunkt steht die Problematik, ob sich sog. Außenseiter am Arbeitskampf aktiv beteiligen und ob sie passiv in den Arbeitskampf einbezogen werden werden dürfen. Außenseiter lassen sich schlagwortartig als Nicht- oder Andersorganisierte bezeichnen; sie sind Arbeitnehmer bzw. Arbeitgeber, die nicht in der Gewerkschaft bzw. dem Arbeitgeberverband organisiert sind, die den umkämpften Tarifvertrag abschließen. Dem Autor gelingt es, die Arbeitskampfbeteiligung der Außenseiter auf eine überzeugende und tragfähige rechtsdogmatische Grundlage zu stellen. Da das Arbeitskampfrecht auf der Koalitionsfreiheit (Art. 9 Abs. 3 GG) aufbaut und streng tarifvertragsbezogen ist, scheidet die Beteiligung der Außenseiter auf kollektivrechtlicher Grundlage aus. Ihre Arbeitskampfbeteiligung läßt sich aber auf individualrechtlicher Ebene schlüssig und zugleich praktikabel begründen, wenn und soweit in ihrem Arbeitsverhältnis auf den umkämpften Tarifvertrag dynamisch Bezug genommen wird.
