The railway construction and operating regulations are the most important regulatory framework for the safety and order of railway operation. The commentary is irreplaceable for coping with the diverse tasks of railways, regulators, rail service orderers, the railway construction and rail vehicle industry, or the experts. The revised and updated 7. Edition has been updated and contains all changes that have occurred since the last edition from 2020. The commentary has been continuously revised and revised in many parts to meet the developments in recent years since the release of the pre-edition. These include: • A.VII: Significant extension and update of the comment on the construction of a railway (plan approval), • § 1: Expansion of the comment on "comprehensive conversions", • § 2: Significant extension of commentary on issues of safety in railway operations, • § 28: Significant expansion and updating of the Comment on the Comment on equipment, in particular through the progressive implementation of the train control and train control system "European Train Control System" (ETCS), • §§ 47ff. : Significant extension of commentary on the requirements for "workers", in particular with regard to their suitability, • Adaptations to the accident prevention regulations cited in Chapter A.IX, and • Extensive adjustments and additions based on new/current case law. Furthermore, innovations that have an influence on the railway construction and operating regulations were taken into account: • Entry into force or changes of paragraphs of the General Railway Act (in particular §§ 18, 22b, 24 et seq. AEG), with effects on commenting (in particular to § 17 EBO) and extension of the overview in chapter A.II.. Current "railway specific technical building regulations" (EiTB) by the EBA in the version valid from 1 January 2023, entry into force of Regulation (EU) 2021/782 of the European Parliament and of the Council of 29 April 2021 on the rights and obligations of passengers in railways. Entry into force of the Structural Strengthening Act of Kohleregionen (KStrStG) of 8 August 2020 on the extended jurisdiction of the Federal Administrative Court, • Entry into force of the Act on Acceleration of Investments of 3 December 2020, in particular to delineate "entertainment" and "change" of the operating facilities of a railway and • . Railway Regulation Law of 9 June 2021, in particular defining the concept of "railway facilities".
