Description
Russia's war of aggression on Ukraine and the subsequent sanctions packages have changed the entire foreign trade sustainably. In addition, the Sanctions Enforcement Acts I and II have led to the creation of a new authority that has extensive powers of intervention in the field of financial sanctions. As a result, foreign trade law for all economic actors has gained momentum and complexity to an unprecedented extent. The new edition of the Heidelberg commentary on foreign trade law of Sachs/Pelz shows practice-oriented and well-founded which new regulations the practice must now adjust. This is new: • The EU Dual-Use Regulation (VO (EU) 2021/821) replaced the EC Dual-Use Regulation on 9.11.2021 with far-reaching consequences for practice. In the future, the protection of human rights, especially for goods for digital surveillance, will increasingly become the focus of export control. This includes more intensive information exchange between Member States and increased transparency obligations. For the first time, approval requirements for technical support have also been created. Changes have also been made in the control of brokerage activities and transits. • Investment control schemes have been modified in view of the changed geopolitical developments. • The new Sanctions Enforcement Act (SanktDG) created administrative instruments for identifying and securing assets, flanking the existing criminal law instruments. A comprehensive commentary by the SanktDG shows the implementation in practice. The new edition of the Heidelberger Commentary on Foreign Trade Law offers the entire legal spectrum of foreign trade law at a cutting-edge state: • Comprehensive and practice-oriented comments of the AWG, AWV, SanktDG and the EU Dual-Use VO (VO (EU) 2021/821). • Detailed explanation of EU sanctions law and embargo rules using standard words. • Experts of American law go into detail on issues of US export control and sanctions law that are important to EU companies (in English). • Help implement internal compliance programs in enterprises. The editor and author team consists of proven national and international experts from consultants, ministries and academia and is a guarantee of comprehensive and balanced information on foreign trade law.
