Bei der Laienwerbung handelt es sich um eine Werbemethode, die fast bei jedem Unternehmen zu finden ist. Als derart verbreitetes Werbemittel hat sie auch schon früh die Beachtung der Wettbewerbsjuristen gefunden. Für den Wettbewerbsrichter bringt die Laienwerbung einige Herausforderungen mit sich, mit denen sich der Bundesgerichtshof explizit zuletzt 2006 konfrontiert sah. Sein Kunden-werben-Kunden-Urteil warf einige Fragen hinsichtlich der künftigen angemessenen wettbewerbsrechtlichen Beurteilung der Laienwerbung auf. Diesen Fragen geht die Studie nach. Das Werbemittel Laienwerbung wird zunächst aus Sicht des Marketings dargestellt, woraufhin auf die wettbewerbsrechtliche Bewertung in Rechtsprechung und Literatur eingegangen und erörtert wird, inwieweit sich unter dem neuen Bundesgesetz gegen den unlauteren Wettbewerb Änderungen ergeben haben könnten. About the Author Steffen Burrer studierte Rechtswissenschaften mit wirtschaftswissenschaftlicher Zusatzausbildung sowie einer fachspezifischen Fremdsprachenausbildung in Englisch und Französisch an der Universität Bayreuth. Derzeit ist er Anwalt in einer Münchner Sozietät.
