Die spanische Verfassung gibt keine spezifische Territorialstruktur vor, weswegen kontrovers diskutiert wird, wie der auf der Grundlage dieser Verfassung entstandene Staat der Autonomen Gemeinschaften einzuordnen ist. Diese Arbeit stellt die für das Verständnis der heutigen Verfassungslage erforderliche Entwicklung Spaniens ebenso umfassend dar wie den verfassungsrechtlichen Rahmen des Staates der Autonomen Gemeinschaften und dessen Ausfüllung. Darauf aufbauend wird untersucht, inwiefern föderale Elemente diese territoriale Struktur prägen, wobei insbesondere die verfassungsrechtliche Position des spanischen Senats analysiert wird. Die abschließende Klassifizierung der Territorialstruktur erfolgt vor dem Hintergrund der Existenz zahlreicher asymmetrischer Elemente.
