The exploration of critical incidents in law enforcement focuses on the distinction between truth and fact, particularly in high-stakes situations where an officer’s perception greatly influences their actions. Truth, as understood from an officer’s perspective, encompasses the subjective data shaped by human factors and decision-making under time constraints, especially during critical incidents where the stakes involve life and death. In contrast, “fact” represents objective data that can be obtained through thorough investigation, allowing for more accurate assessments when time and consequences are not a factor. Officers’ decisions are understandably judged against this objective standard in hindsight, as per (Graham v. Connor, 490, U.S. 386, 1989). However, this can create a disconnect between what an officer believes to be true in the heat of the moment and what is later determined to be factually accurate. This defines the question; was it reasonable for the officer to “believe” the perceptions to be true as behavior and evidence is reviewed in hindsight. The reality of use-of-force policies further complicates this discourse, with phrases like, “an officer will use only that force which is objectively reasonable,” suggesting a clear standard that officers must adhere to, used almost as a decision model in policy form. Yet, officers often operate based on their perceptions of immediate threats in split-second scenarios, without any way of predicting components which are used in the hindsight analysis of the incident, which may or may not align with what appears reasonable in a calm, judicial review. The calculus for objective reasonableness was developed for use as a hindsight analytical tool. This potential for dissonance in the thought process can result in a more complex emotional aftermath for officers involved in high-pressure situations. This is the foundation for a reviewer’s strong or passionate belief of what occurred as being “right or wrong,” as opposed to the dispassionate review of all facts known in hindsight. Understanding the application of scientific principles, such as focus of attention and situational awareness, is crucial for investigators and those reviewing and analyzing force incidents. Officers are trained in these principles, which impacts their response to critical incidents. The ability to articulate the psychological and physiological aspects of decision-making during high-stress situations helps in framing investigations beyond mere procedural compliance, offering a deeper contextual understanding of each incident. The training environment, traditionally sterile, contrasts starkly with real-life encounters that present unpredictable dynamics. This discrepancy must be clarified when reviewing incidents, emphasizing the need for comprehensive and empathetic assessments. Investigators must be aware that reading and memorizing policy does not equate to a full grasp of application in real-world scenarios, solidifying the importance of practical training and understanding within the scope of their responsibilities.
