Description

Derived from the renowned multi-volume International Encyclopaedia of Laws, this book provides a practical analysis of criminal law in Uganda. An introduction presents the necessary background information about the framework and sources of the criminal justice system, and then proceeds to a detailed examination of the grounds for criminal liability, the justification of criminal offences, the defences that diminish or excuse criminal liability, the classification of criminal offences, and the sanctions system. Coverage of criminal procedure focuses on the organization of investigations, pre-trial proceedings, trial stage, and legal remedies. A final part describes the execution of sentences and orders, the prison system, and the extinction of custodial sanctions or sentences. Its succinct yet scholarly nature, as well as the practical quality of the information it provides, make this book a valuable resource for criminal lawyers, prosecutors, law enforcement officers, and criminal court judges handling cases connected with Uganda. Academics and researchers, as well as the various international organizations in the field, will welcome this very useful guide, and will appreciate its value in the study of comparative criminal law. About the Author Judge Daniel David Ntanda Nsereko was born and raised in the Masaka District of Uganda. He attended Kabuwoko Boys' Primary School, Kako Junior Secondary School and King's College Budo. He holds an LLB degree from the University of East Africa, MJC degree in Comparative Jurisprudence from Howard University and LLM and JSD degrees from New York University. Judge Nsereko was appointed by the UN Secretary-General Appeals Judge of the Special Tribunal for Lebanon on 29 February 2012. Before his appointment, Judge Nsereko served as Judge of the International Criminal Court (ICC). He served as President of the Appeals Division from March 2009 to March 2010. Before his election to the ICC, Judge Nsereko served as Professor of Law at the University of Botswana, where he headed the Law Department for eight years. He also previously served as the Walter S. Owen Visiting Professor of Law at the University of British Columbia Faculty of Law, Vancouver, Canada, Visiting Professor at Teramo University in Italy and as Senior Lecturer at Makerere University in Uganda. As a professor and scholar, Judge Nsereko specialized in the areas of Public International Law, International Criminal Law, International Human Rights Law, Criminal Law and Criminal Procedure and Constitutional Law. He has also published extensively in these areas. He is a member of the editorial boards of several international learned periodicals, including Criminal Law Forum, Journal of Church and State and the University of Botswana Law Journal. Judge Nsereko also served on the Advisory Committee of the War Research Office of the American University Law School in Washington DC, provided expert legal opinions to various international adjudicatory bodies and served as a trial observer in several countries.
