El objetivo de este ensayo es presentar las medidas cautelares y debatir su impacto en la sociedad de la información, en relación con la protección de la intimidad en Internet, a la luz del derecho fundamental a la jurisdicción efectiva. Si, por un lado, el auge de la era de la información ha contribuido al desarrollo general de la civilización, proporcionando el crecimiento del conocimiento, basado en el acceso fácil y rápido a la información, por otro lado, cuanto más el uso de la tecnología de la información facilita la interconexión de las personas, más permite la formación de grandes bases de datos que invaden la vida de los individuos, sin su autorización o incluso sin su conocimiento. Los cambios producidos por la Sociedad de la Información hacen necesario que el Derecho regule las nuevas situaciones surgidas. Para ello, es imprescindible que el juez conozca esta realidad para aplicar la técnica procesal más adecuada a las necesidades del derecho sustantivo, como consecuencia del derecho fundamental a la jurisdicción efectiva, para ofrecer una tutela judicial dirigida a inhibir la vulneración del derecho a la intimidad en Internet, garantizando los derechos fundamentales de los ciudadanos.
