La présence chez la victime d'un état antérieur pouvant interférer avec les conséquences d'un traumatisme oblige le médecin expert à adopter un raisonnement particulier dans l’étude de l'imputabilité et dans la quantification des chefs de préjudice. Il est ainsi demandé au médecin expert de préciser la nature et l’étendue exacte du seul dommage découlant directement de l’événement litigieux. Le but de ce travail était d’exposer les différentes interférences médicales de l’état antérieur sur les conséquences des événements litigieux, d’analyser les critères d'imputabilité à partir desquels le médecin expert doit tirer ses déductions et d’étudier les répercussions du raisonnement médical sur les décisions juridiques ou du régleur.
