La République Démocratique du Congo (R. D. C.) est régie actuellement par la Constitution du 18 Février 2006, approuvée par référendum du 18 et 19 décembre 2005 par la majorité du peuple congolais, telle que modifiée à ce jour. Cette Constitution dispose en son article 17 Alinéas 3 à 5 : "Nul ne peut être poursuivi pour une action ou une omission qui ne constitue pas une infraction au moment où elle est commise et au moment des poursuites. "Nul ne peut être condamné pour une action ou une omission qui ne constitue pas une infraction à la fois au moment où elle est commise et au moment de la condamnation. "Il ne peut être infligé de peine plus forte que celle applicable au moment où l'infraction est commise" .
