Bescheide des Bundesasylamtes sind seit 1.7.2008 beim Asylgerichtshof anfechtbar. Der Asylgerichtshof an sich bietet unerschöpfliches Material für eine wissenschaftliche Untersuchung und Kritik ? besondere Beachtung verdient jedoch die Möglichkeit des Asylgerichtshofes in Kooperation mit dem Verwaltungsgerichtshof Grundsatzentscheidungen gem Art 129e Abs 1 zweiter Satz B-VG zu erlassen. Die verfassungsrechtlichen Bestimmungen werfen schwerwiegende Fragen auf: Sind Grundsatzentscheidungen eine neue Rechtsquelle? Können Grundsatzentscheidungen geändert werden? Wenn Ja, von wem? Ist auch der Verfassungsgerichtshof an Grundsatzentscheidungen gebunden, selbst wenn sie verfassungswidrig sind? Darf der Bundesminister für Inneres jede Frage zur Grundsatzfrage machen? Zu Beginn werden die (österreichischen) Vorbildmodelle der Grundsatzentscheidung dargestellt. Eine ausführliche Auseinandersetzung mit der verfassungsrechtlichen Grundlage und den einfachgesetzlichen Bestimmungen soll zeigen, welche neuen Wege der Gesetzgeber mit der Grundsatzentscheidung beschritten hat und wie die Bestimmungen in der Praxis auszulegen sind.
