In het Nederlandse recht wordt bij herhaling de tournure toegepast dat een overigens geldige regel niet ingeroepen kan worden omdat dit gelet op de eerdere gedragingen van de rechthebbende onaanvaardbaar zou zijn naar maatstaven van redelijkheid en billijkheid. In de civil law jurisdicties staat dit bekend als het beginsel venire contra factum proprium, een van de Fallgruppen van de redelijkheid en billijkheid. In standaardarresten als Baris/Riezenkamp (NJ 1958, 67) kan het venire contra factum proprium beginsel worden herkend, maar het wordt niet altijd als zodanig benoemd. In dit boek wordt ervan uitgegaan dat het juist wenselijk is dit beginsel te herkennen en te erkennen. Onderzocht wordt of lering getrokken kan worden uit het Engelse recht, waar met het leerstuk estoppel al eeuwen invulling wordt gegeven aan dit beginsel. Over de auteur: Jeroen Ermers behaalde in 2010 de master rechtswetenschappen aan de Open Universiteit. Hij is als jurist werkzaam bij het Uitvoeringsinstituut werknemersverzekeringen. In 2014 promoveerde hij op het onderzoek naar het common law leerstuk estoppel aan de Open Universiteit.
