Hacia la década de 1880, una vez terminada la Guerra del Pacífico, Chile ve como se consolida un nuevo tipo de Estado construido a la usanza de una elite oligárquica que logra fusionar perfectamente su preponderancia económica y política. Al implementar este proyecto de dominación, la elite oligárquica dispone de una serie de recursos con los cuales este orden político, social y económico por ellos diseñado perdure en el tiempo. Entre estos recursos contamos con los dispositivos de control social (léase Fuerzas Armadas y de Orden y el ordenamiento jurídico-penal)y con los medios de represión, los que garantizaban la mantención tanto del statu quo como el orden público. Para aproximarnos a este rol coactivo del Estado chileno entre 1880 y 1920, escogimos a la otrora boyante provincia minera de Atacama que, en su contexto de crisis, reunió, a nuestro entender, las condiciones necesarias para observar en ella el enérgico despliegue de los medios de violencia que policías, militares, jueces y recintos carcelarios dispusieron para, en la mayoría de los casos, de modo arbitario y excesivo, reprimir y penalizar las distintas formas de trangresión social.
