A la commission d'une infraction, le suspect est interpellé devant une autorité judiciaire. On lui pose un tas de question, et il ne sait toujours pas pourquoi il a été interpellé, il ne sait pas ce qu’il peut ou ce qu’il doit faire. C’est en effet à ce niveau qu’il doit lui être rappelé qu’il a le droit de garder silence. Ce droit signifie avant tout, que le refus d’explication et le manque d’explication de la personne poursuivie ne peuvent, seuls entrainer la preuve tacite de sa culpabilité. Ce droit sert de transition entre deux principes diamétralement opposés : la présomption d’innocence et la présomption de culpabilité. c'est dans ce sens que le droit au silence en met en œuvre l’équitabilité du procès et ainsi débarrasser le droit de sa raideur, de son emphase, pour faire retrouver toute la société de la fraicheur et de la saveur du droit en le rendant moins arrogant, plus humain, moins antipathique. Tel doit être l'objectif de la justice pénale contemporaine
