Un constat s'impose : le droit du procès civil fait l'objet, depuis quelques années, d'une suite incessante de lois nouvelles, se traduisant tantôt par la refonte complète de pans entiers de la procédure, tantôt par des adaptations plus ponctuelles, mais ayant toutes des répercussions considérables dans le quotidien des praticiens du "droit du Palais" . Ces modifications dépourvues de cohérence ont parfois des effets aussi inattendus que bouleversants et impliquent souvent de revoir à bref délai des textes à peine votés. Ainsi en va-t-il notamment de la poursuite de la réforme de la théorie des nullités et du nouveau régime de nullités pour non-respect de la loi sur l'emploi des langues en matière judiciaire, des conséquences procédurales de l'absence d'inscription de la cause au rôle au plus tard la veille de l'audience, de la modification des pouvoirs du juge statuant par défaut, des changements relatifs aux montants et au moment d'exigibilité des droits de greffe, des nouveautés en matière de rectification des jugements, ou encore des restrictions apportées à l'exercice des voies de recours ordinaires. A l'instar de la législation, la jurisprudence continue elle aussi à évoluer. Pour ne prendre qu'un exemple, la recevabilité de l'appel incident et la cohérence entre les notions de lien d'instance et d'intérêts opposés en appel suscitent toujours des interrogations. La pratique judiciaire se transforme également, avec l'entrée en vigueur de la plate-forme DPA pour la remise électronique des conclusions et des pièces. Plus généralement, l'informatisation du procès civil et l'incursion - parfois forcée - de la conciliation et de la médiation en cours de mise en état préfigurent avec le projet de tribunal du futur des remaniements importants de l'instruction des causes. C'est dans ce contexte changeant que l'Unité de droit judiciaire de l'ULB publie le volume 2 du Droit du procès civil. Les sujets traités par ce volume sont l'introduction des demandes, leur instruction (depuis l'audience d'introduction jusqu'au prononcé du jugement définitif), l'appel, le défaut et l'opposition. Pour chacune de ces étapes du procès civil, toutes les réformes récentes et tous les projets annoncés sont intégrés dans une analyse approfondie, chronologique et fonctionnelle.
