Product Description L’intérêt croissant de la doctrine pour les conflits de droits contraste avec l’écho limité de ce thème dans la jurisprudence de la Cour européenne des droits de l’Homme alors même que leur résolution représente pour la juridiction européenne un défi méthodologique et politique. Ainsi, les conflits de droits ne sont pas systématiquement identifiés par la Cour européenne, ce qui contraint à un travail de délimitation de cette catégorie avant même de pouvoir analyser et évaluer les méthodes de résolution de ces litiges particuliers. Alors que les conflits de droits constituent un ensemble hétérogène de litiges, de structure et de contenu variables, la Cour n’a pas sensiblement adapté son raisonnement à cette spécificité. Si la Cour privilégie la proportionnalité ou la balance pour appréhender les conflits de droits, l’apparente simplicité de cette démarche est remise en cause par la présence d’une certaine hiérarchie au sein des droits de la Convention et par les défauts que la proportionnalité révèle lorsqu’elle est utilisée pour résoudre ces litiges. Pour autant, ce n’est pas dans une méthode fondée sur la seule hiérarchie, ni sur des alternatives à la proportionnalité comme la concordance pratique, que réside la solution des difficultés posées par la présence des conflits de droits dans l’ordre européen mais dans la reconstruction d’un cadre de résolution permettant d’adapter la balance aux spécificités de cette catégorie particulière de litiges.
