Le droit à un procès équitable devant la Cour pénale internationale: mythe ou réalité Le droit à un procès équitable constitue l'un des principes fondamentaux de la justice pénale internationale. Le non-respect de ce principe fondamental risque de compromettre la crédibilité du système de justice pénale internationale. Toutefois, le droit d'être jugé dans un délai raisonnable a suscité des controverses parmi les autres composantes du droit à un procès équitable : les premières affaires devant la Cour pénale internationale ont été clôturées, en moyenne, au bout de dix ans, alors que devant des juridictions nationales, telles que la cour d'assises de Paris ou de Bruxelles, des affaires de même nature étaient jugées en un à trois ans. La présente recherche vise donc à comprendre les raisons d'un tel écart entre la Cour pénale internationale et les juridictions nationales quant aux délais de clôture des affaires. La gestion électronique des éléments de prevue, et plus particulièrement les tâches chronophages incombant au gestionnaire de dossier, qui doit convertir manuellement tous les éléments de preuve en données électroniques et en saisir tout aussi manuellement les métadonnées, constitue l'élément majeur différenciant la manière dont les affaires sont menées devant les juridictions nationales et devant la Cour pénale internationale : alors qu'il n'existe aucune obligation, devant les juridictions nationales, de convertir tous les éléments de preuve en données électroniques, une telle obligation s'impose devant la Cour pénale internationale en vertu du « protocole e-Court », contraignant le gestionnaire de dossier à accomplir ce processus fastidieux qui influe sur la durée du procès. Il existe une véritable lacune dans le domaine de la justice pénale internationale : aucune publication ne traite de l’incidence de la mise en œuvre du « Protocole e-Court » sur la durée du procès, et plus particulièrement sur le droit d’être jugé sans retard excessif, composante du droit à un procès équitable. La présente recherche a le mérite de combler cette lacune et de proposer des mécanismes, inspirés de la pratique des juridictions nationales, visant à accroître l’efficacité de la Cour pénale internationale.
