Description

Examinations into the causes of disputes internationally have shown that failure of the parties to correctly administer the contract and to submit notices are major causes of time-consuming and costly disputes. The 1999 FIDIC Red Book contains approximately 60 clauses that require one of the Parties or the Engineer to give notice under certain circumstances. A few of these are commonly known and used, but many are not. Even when notices are submitted, they frequently fail to properly comply with the Contract. This book examines every clause of the 1999 FIDIC Red, Yellow and Silver books which requires either the Contractor, the Employer of the Engineer to submit notices. The guide includes quotations from the clauses that require the giving of notices, followed by an explanation of why and under what circumstances they are required, their content and the information that should be included. Examples of the wording and format of suitable notices are also included for each clause. As well as a specific examination of each clause requiring notices, guidance is also given about general contract administration for notices from the Contractor, Employer and Engineer’s points of view.
