Dit boek behandelt de geschiedenis van de codificatie, een juridisch verschijnsel dat al sinds de Romeinse oudheid bekend is, maar in de Verlichting zijn naam en zijn herkenbare gestalte heeft gekregen. De behandelde stof behoort tot het gebied van het publieke recht, ook al is gekozen voor de codificatie van het privaatrecht. Aan de orde komen publiekrechtelijke vragen: Is een codificatie een noodzakelijk verschijnsel? Geeft zij de verlangde rechtszekerheid? Hoe is de verhouding tussen de wetgever die de codificatie vaststelt en de rechter die haar uitlegt? Gekozen is voor een opzet waarin de codificatiegeschiedenis van een aantal landen van West-Europa (Italië, Frankrijk, Duitsland, Nederland en Zwitserland) met elkaar wordt vergeleken. De gemeenschappelijke West-Europese geschiedenis komt aan de orde in de twee hoofdstukken over het Natuurrecht en het Romeinse recht. Een afzonderlijk hoofdstuk is gewijd aan Engeland dat geen codificatie kent. De hoofdstukken staan op zichzelf en kunnen afzonderlijk worden gelezen. Het boek is bedoeld als leerboek en richt zich niet alleen tot de rechtenstudenten maar ook tot studenten in de historische en algemeen maatschappelijke vakgebieden en – meer in het algemeen – tot al degenen die in het recht en de geschiedenis zijn geïnteresseerd.
