Przyznając status porządku publicznego normom prawnym zawartym w Jednolitych Aktach Organizacji Harmonizacji Prawa Gospodarczego w Afryce (OHADA), prawodawca OHADA najwyraźniej odszedł od celu, do którego dążył Traktat OHADA podpisany w dniu 17 października 1993 r. w Port-Louis (Mauritius). Zgodnie z Traktatem, wspólne standardy muszą być proste, nowoczesne i dostosowane do gospodarek państw-stron. Jednak ze względu na imperatywny charakter lub sztywność, które charakteryzują porządek publiczny, może się okazać, że przepisy porządku publicznego są niezgodne z elastycznym podejściem prawnym zalecanym dla danego jednolitego aktu. Należy zatem znaleźć mechanizmy umożliwiające dostosowanie przepisów porządku publicznego do jednolitych aktów prawnych. Zmiana ta polegałaby na dostosowaniu ram wyrażania przepisów porządku publicznego w aktach jednolitych, po pierwsze poprzez deregulację wspomnianych przepisów porządku publicznego, a po drugie poprzez wybór nowego podejścia prawnego znanego jako "regulacja".
