Dies ist eine Reflexion über Menschenrechte aus einer dekolonialen Perspektive. Wir gehen von der dekolonialen Perspektive des Wissens aus, als erkenntnistheoretische Abkehr von der Vorstellung, dass wir die intellektuelle und kulturelle Kolonie Europas sind. Von dort aus analysieren wir die historische Konstruktion der Moderne, die mit der Invasion der europäischen Völker auf dem amerikanischen Kontinent begann und von den Kolonialitäten der Macht, des Wissens und des Seins geprägt ist, was zur Verschleierung der Vielfalt in der gesamten Moderne führt. Damit ist es möglich, den Einfluss der Kolonialität auf die Entstehung des Völkerrechts aufzuzeigen, genauer gesagt auf das, was wir Menschenrechte nennen; es werden einige Überlegungen zum Konzept der Menschenrechte angestellt, um den Einfluss der im modernen/kolonialen Weltsystem etablierten Macht- und Wissensstruktur auf die Menschenrechte zu bewerten. Schließlich wird der interkulturelle Dialog durch eine diatopische Hermeneutik als Alternative zum hegemonialen Diskurs der Menschenrechte vorgeschlagen.
