Das vorliegende Papier analysiert die Anwendbarkeit der Datenschutzvorschriften auf die Handelsschiedsgerichtsbarkeit. Dieses Thema wurde im Zusammenhang mit der Verabschiedung des neuen Datenschutzrahmens der Europäischen Union, nämlich der Allgemeinen Datenschutzverordnung (DSGVO), besonders relevant. Die GDPR stellt erhebliche Anforderungen an Organisationen, die mit der Verarbeitung von Daten befasst sind. Ziel ist es, die Hauptakteure in der Handelsschiedsgerichtsbarkeit dabei zu unterstützen, die Einhaltung der Datenschutzvorschriften zu gewährleisten. In fünf Kapiteln untersucht der Autor (i) die Rolle der Schiedsrichter, der Schiedsinstitutionen, der Anstellungsbehörden und anderer wichtiger Teilnehmer am Schiedsverfahren aus der Perspektive des Datenschutzes; (ii) analysiert die verschiedenen Arten personenbezogener Daten und die möglichen Rechtsgrundlagen für ihre Verarbeitung in Schiedsverfahren; (iii) konzentriert sich auf die Rechte der betroffenen Personen nach der DSGVO und ihre möglichen Einschränkungen in Schiedsverfahren; (iv) beschreibt die Pflichten der für die Datenverarbeitung Verantwortlichen in Schiedsverfahren; (v) untersucht die Zukunft der Schiedsverfahren und den möglichen Einsatz von künstlicher Intelligenz. Das Buch enthält auch eine Muster-Datenschutzrichtlinie für Schiedsinstitutionen.
