Sur confiance réciproque leurs justices, les États se reconnaissent l’autorité négative de leur chose décidée à l’intérieur de cet espace de Liberté, de Sécurité et de Justice. Le principe ne bis in idem (interdiction de double jeopardy) transnational y émergeant requiert l’unicité des poursuites pénales à charge d’un défendeur en raison de la même infraction ou de mêmes faits matériels. Son application dépend de son interprétation harmonisée, tenant compte des intérêts de tous les acteurs de la scène pénale (défendeur, partie civile, partie publique à l’intérieur d’un État voire entre États différents). De ses définitions par la CEDH, la CJUE, les juridictions anglaises et belges se dégage un consensus pour son interprétation étroite (autrefois acquit ou convict). En revanche, son interprétation large, interdiction (d’abuse of process) de toute nouvelle poursuite du même fait matériel, quel qu’en soit la qualification juridique, diverge. Elle dépend de l’étendue du pouvoir de l’organe décidant, vidant ou non le fait dans ses rapports au(x) droit(s).
