Si la littérature juridique s’est fort intéressée aux juges suprêmes du Conseil d'Etat, peu d’écrits font part du statut, de l’activité et de la mission du juge administratif de première instance. Pourtant, quantitativement et qualitativement, le rôle des juges des tribunaux administratifs est fondamental dans l’élaboration de nouvelles règles de droit. Plus de quatre-vingt dix pour-cent des affaires contentieuses relèvent de leur compétence. Pour l’administré, le juge de première instance reste l’interlocuteur le plus proche en cas de litiges rencontrés avec l’administration. Malgré une présence discrète, la justice administrative du premier degré est reconnue pour ses compétences techniques et parfois pour l’impact social et politique que ses décisions peuvent revêtir. Elle devient la tribune de l’exutoire des passions et des rancoeurs politiques locales. Elle reste aussi le lieu où se tranchent les «litiges du quotidien» des administrés.
