La responsabilité des prestataires intermédiaires de services en ligne, plus connus sous le nom d’intermédiaires de l’Internet, clive le monde juridique depuis plusieurs années déjà sans qu’une solution consensuelle n’ait encore émergé. L’auteure revient au source de la matière en comparant le système de responsabilité civile des prestataires intermédiaires telle qu’elle est née et s’est développée jusqu’en 2010 aux États-Unis avec les systèmes européen et français de responsabilité afin de mettre en évidence la fonction de régulation jouée par la responsabilité civile, institution de droit privé traditionnellement associée à des fonctions de compensation et/ou de prévention. L’auteure montre que dans chacun de ces trois systèmes l’introduction de règles ad hoc de responsabilité ont servi à déléguer des pans entiers du processus de régulation et identifie quatre modèles distincts de régulation des contenus en ligne, chacun provenant d’un dosage particulier d’exemptions de responsabilité et de sanctions. L’auteure conclut que l’apparition de ces modèles peut s’expliquer par la tradition régulatoire de chacun des systèmes étudiés et préconise une approche sectorielle de la matière.
