L’importance croissante prise par les services financiers dans la vie économique nécessite leur encadrement et leur surveillance par les autorités de régulation. La régulation désigne les nouvelles modalités d’intervention de l’État, dans un environnement instable et complexe, par l’intermédiaire d’autorités administratives, dotées d’une certaine autonomie. Le recours à des activités de régulation est devenu un mode d’exercice de la puissance publique, de plus en plus utilisé, tant sur le plan national français qu’à l’échelle communautaire et internationale. Désormais, au moment où de nombreux auteurs affirmaient que "le concept de régulation n’était pas juridique", la crise financière qui s’est développée depuis l’été 2007 aux États-Unis a marqué un retour du balancier avec une importance accrue accordée aux questions de régulation. Si la dimension européenne et internationale des affaires s’est accompagnée d’un changement de la conjoncture économique, les secousses financières cataclysmiques survenues outre-Atlantique ont entraîné un ralentissement de l’économie mondiale, mettant en exergue l’insuffisance de la régulation dans un système bancaire et financier globalisé.
