L'opinion publique s'émeut : cela ressemble à l'Holocauste et on ne peut plus dire que l'on ne savait pas. Mai 1993. Après plusieurs mois de discussions, le Conseil de sécurité des Nations unies adopte une résolution qui entérine la création du Tribunal pénal international pour l'ex-Yougoslavie. Porteur d'une demande essentielle visant la fin du conflit en ex-Yougoslavie, le Tribunal Pénal International est indéniablement une institution originale qui mérite toute l'attention. Organisation hybride née d'une volonté commune de répondre aux crimes de guerre en recouvrant au bras de la justice, il n'est ni une institution commune ni une institution révolutionnaire, et pourtant il reste un moment inédit. Ainsi, la justice pénale internationale renvoie à un mouvement amorcé au lendemain de la Seconde guerre mondiale avec le Tribunal de Nuremberg et culminant avec la création de la Cour pénale internationale.
