Le droit des investissements constitue un laboratoire privilégié pour étudier le phénomène de multiplication des mécanismes de règlement des différends dans la mesure où il existe une interpénétration entre ce domaine et les autres matières du droit international. Le contentieux relatif aux investissements s’inscrit dans une double dimension. Cette concurrence est verticale puisque la frontière entre les ordres juridiques internes et l’ordre juridique international n’est pas étanche pour les investisseurs privés. Cette concurrence est également horizontale dans la mesure où les États se sont regroupés au sein d’organisations d’intégration économique régionales. Le développement exponentiel de ce contentieux répond à une spécialisation fonctionnelle qui s’est doublée d’une dimension géographique. Les normes adoptées dans ce domaine ont permis l’élaboration d’un système complémentaire de mécanismes de règlement des différends.
