Im Jahr 2015 kamen schätzungsweise eine Million Flüchtlinge nach Deutschland, von denen über 300.000 Kinder und Jugendliche waren. Ein nicht unerheblicher Anteil der Kinder und Jugendlichen, die in Deutschland Schutz suchten, waren ohne Begleitung ihrer Eltern. Sogenannte unbegleitete minderjährige Flüchtlinge die auf der Flucht von ihren Eltern getrennt wurden. Sie werden als besonders schutzbedürftig angesehen, da sie unter dem Verlust familiärer Bindungen leiden und in besonderem Maße gefährdet sind, Opfer von Gewalterfahrung, Ausbeutung und Konflikten zu werden. In Deutschland greifen für diese Kinder nun zwei Gesetzformen: Zum einen das Migrationsrecht für asyl- und aufenthaltsrechliche Regelungen und zum anderen die Jugenhilfe mit dem Kinder- und Jugendhilferecht. Das Leben von unbegleiteten minderjährigen Flüchtlingen ist in Deutschland von nun an durch die praktische Ausgestaltung dieser zwei Rechte geprägt. Dieses Buch behandelt die Spannungen welche sich durch diese zwei Gesetzesfelder ergeben können. Speziell beantwortet es die Fragen: Welches Spannungsfeld ergibt sich zwischen dem Migrationsrecht und dem Kinder- und Jugendhilferecht hinsichtlich unbegleiteter minderjähriger Flüchtlinge? Welche Herausforderungen resultieren daraus für die Soziale Arbeit und welche Handlungsempfehlungen lassen sich folglich für Sozialarbeiter/innen ableiten?
