Concevoir un enfant est souvent considéré comme l’un des actes les plus merveilleux que deux être humains puissent accomplir. Avoir un enfant, c’est accompagner un être sur le chemin de la vie, le chérir, lui transmettre ses valeurs. Mais la conception d’un enfant est davantage que simplement donner la vie. Elle engendre également certains enjeux sociologiques (évolution de la notion de « famille »), scientifiques (évolution des méthodes de procréation assistée) et bioéthiques. Dans ce contexte, le Droit occupe un rôle prépondérant. En effet, la conception d’un enfant a historiquement toujours pu être contraire au Droit. Si, auparavant, du fait de l’absence de réelle maîtrise de la procréation, la conception elle-même n’était pas fautive, la place croissante de la volonté dans la conception de l’enfant peut, désormais, faire de celle-ci une faute délibérément commise par les parents. Le désir d’enfant se heurte, en effet, aux limites imposées par le Droit positif, fondé sur nos valeurs fondamentales. Il est alors nécessaire de garder à l’esprit le principe selon lequel « de ce que quelque chose est, il ne peut pas s'en suivre que quelque chose doit être ».
