Le commerce électronique se développe à une vitesse fulgurante. Cependant, ce développement nécessite un corpus juridique afin d’assurer la sécurité juridique de ce phénomène. L’année 2004 a été particulièrement riche sur le plan de la réglementation relative au commerce électronique. L’adoption de la « Loi pour la confiance dans l’économie numérique » vise à favoriser le développement des sociétés de l’information et la création d’un climat de confiance.En outre, l’adoption de cette loi a permis à la France de rattraper son retard par rapport à la transposition de la directive européenne du 8 juin 2000. Le but est honorable ; il s’agit, notamment, d’instaurer une sécurité juridique optimale, en harmonie avec les dispositions communautaires sur le commerce électronique. En Iran, cet objectif a été poursuivi moyennant l’adoption de la « Loi sur le commerce électronique du 7 janvier 2003 ». Bien que pour diverses raisons l’Iran accuse un retard regrettable en matière de commerce électronique, on peut se féliciter , malgré tout, de la volonté du législateur Iranien d’instaurer un corpus juridique adapté au commerce en ligne sans oublier le principe d’harmonisation.
