Product Description Après une prise de conscience des pouvoirs publics sur les nouveaux risques pour la vie privée, les instruments spécifiques sont toutefois apparus inadaptés à la société de l’information. Le législateur européen a donc cherché à les faire évoluer, tout en respectant la liberté de circulation de l’information et en anticipant sur l’évolution rapide de l’outil numérique lato sensu. Si le législateur européen a eu cette volonté salutaire de s’attacher à la protection des données personnelles, tel n’est pas le cas de tous les Etats du monde entier pour qui la protection juridique de la vie privée peut apparaître comme secondaire. Au regard de la circulation mondiale de l’information, cette absence d’unanimité est regrettable car elle fragilise les efforts entrepris par les Etats soucieux de protéger la vie privée. Dans un tel cas de figure et dans l’attente d’une accélération de la prise de conscience, il faut alors compter sur des mécanismes ordinaires issus du droit international privé ou, en cas d’atteinte grave, sur ceux prescrits par le droit pénal international. Toutefois, cette solution est loin d’être idéale car elle subordonne la volonté judiciaire au bon vouloir des Etats.
