Der Schutz geistigen Eigentums gewinnt für viele Unternehmen zunehmend an Bedeutung. Die damit verbundenen juristischen, technischen und betriebswirtschaftlichen Problemfelder dürfen nicht mehr isoliert, sondern müssen - insbesondere aus strategischer Perspektive - ganzheitlich betrachtet werden. Die Autoren beleuchten verschiedene Handlungsfelder, die sich aus einem hyperkompetitiven Umfeld für Unternehmen im Hinblick auf das Patent- und Schutzrechtsmanagement ergeben. Sie vergleichen die Entwicklung des ökonomischen Wettbewerbs mit dem Entstehen militärischer Konflikte und erarbeiten umfassende patentbasierte Strategien für den Einsatz im Hyperwettbewerb. Anhand des neuen deutschen Gebrauchsmusterrechts zeigen sie, dass auch durch gewerbliche Schutzrechte - zumindest temporär - Wettbewerbsvorteile generiert werden können. Da die Fähigkeit, Patentinformationen zu beschaffen und auszuwerten, zu den Schlüsseldeterminanten für die Steigerung der unternehmensindividuellen Wettbewerbsfähigkeit zählt, werden zwei internetbasierte Servicedienste vorgestellt. Abschließend wird anhand des Beispiels "Elektrochemische Energiewandler" verdeutlicht, wie neue Technologien ganze Industriezweige umwälzen und dadurch vor erhebliche Herausforderungen stellen.
