Cette étude est consacrée à l'examen des mécanismes de protection internationale au bénéfice de l'enfant prévus par le droit congolais. Pour ce faire, elle a choisi deux exemples en guise d'illustration : l'adoption internationale et l'enlèvement international d'enfants. Elle part de l'idée que la place de l'enfant dans la tradition africaine influe fortement sur son degré de protection dans le droit moderne, car l'autorité croit que l'enfant est déjà pris en charge par la famille élargie et le clan en application du principe de solidarité cla-nique, et qu'il ne peut donc tomber dans le besoin et l'abandon. Malheureusement, cette croyance est fausse. L'étude analyse le système de l'adoption en RDC où le Code de la famille de 1987 organise une adoption simple, à l'exclusion de l'adoption plénière. Elle analyse aussi le système de la garde d'enfants en cas de séparation parentale ou de divorce. Ici, la garde de l'enfant est automatiquement attribuée à l'un des parents, (souvent le père) et à son clan et ce clan est déterminé à l'avance avant la naissance de l'enfant. Par ailleurs, le droit congolais fait la part belle aux règles coutumières bantoues d'après lesquelles l'enfant nfest pas un sujet de droit à part entière au même titre que les adultes et ne peut prétendre aux mêmes droits. Il appartient au contraire à sa famille et à son clan dont il doit assurer la survie. Et ce but de l'enfant se confond avec celui du mariage dans sa triple dimension d'alliance, de contrat et d'institution de protection. Dans ce contexte, l'Etat doit s'attaquer au dualisme juridique et donner un sens à son appartenance à la famille moniste pour permettre à l'enfant de bénéficier de la protection prévue par la CDE et le droit moderne en général. Ainsi posé, le problème dépasse le seul cadre de la RDC pour embrasser l'ensemble des pays subsahariens. Un premier regard cursif sur la situation dans les autres pays des Grands lacs africains (le Rwanda et le Burundi) a confirmé cette impression.
