Das vorliegende Buch widmet sich der „Kind als Schaden“-Rechtsprechung und beleuchtet das Zusammenwirken der strafrechtlichen Vorschriften über den Schwangerschaftsabbruch mit dem zivilen Arzthaftungsrecht unter dem Einfluss des Verfassungsrechts. Die Abtreibungsregelungen gehören schon seit jeher zu den am heftigsten umstrittenen Bestimmungen des deutschen Strafgesetzbuches. Heute entfalten diese Vorschriften ihre Bedeutung jedoch primär nicht im Straf-, sondern vor allem im Zivilrecht und werfen dabei neue Probleme auf: Misslingt ein Abbruch oder unterbleibt dieser aufgrund eines Arztfehlers ganz, so stellt sich neben der Frage nach der strafrechtlichen Zulässigkeit des Schwangerschaftsabbruchs vor allem die zivilrechtliche Frage nach etwaigen Schadensersatzansprüchen der Eltern gegen den pflichtwidrig handelnden Arzt (sogenannte Klagen aus „wrongful birth“). Hierbei ist die konkrete Ausgestaltung der Ausnahmevorschrift des § 218 a StGB von entscheidender Bedeutung. Das Werk unterzieht daher sowohl die Norm selbst als auch deren Auslegung und Anwendung durch die zivilgerichtliche Rechtsprechung einer kritischen Würdigung und diskutiert Lösungsansätze für eine Neuregelung.
