В монографии опубликован цикл статей, посвященных проблемам модернизации системы гражданского права, являющегося основной отраслью частного права и правовой основой экономической деятельности. Акцент сделан на несоответствии правовых приемов и средств гражданско-правового регулирования, применяемых в процессе воздействия норм гражданского права постсоветских государств на участников экономической деятельности, содержанию диспозитивного метода гражданского права развитых демократий. Делается вывод о том, что гражданское право постсоветских государств характеризуется нормативно-ограниченной диспозитивностью.В рамках анализа проблем гражданско-правового метода проводится классификация норм гражданского права, рассматривается методика из толкования, на основании чего вносятся предложения по совершенствованию системы гражданского права с целью придания гражданско-правовому методу свойств диспозитивного метода, присущего гражданско-правовому регулированию, применяемому в развитых демократиях.
