Inhaltlich unveränderte Neuauflage. Im Zuge der fortschreitenden europäischen Integration sind auch die nationalen Sozialsysteme zunehmend dem Einfluss der Handlungs- und Entscheidungslogiken der EU-Institutionen unterworfen. Mit dem EuGH verbindet sich dabei die Besonderheit, dass er als letztinstanzliches Gericht die Anwendung des europäischen Rechts verbindlich festzulegen vermag, ohne dabei unter politischem Rechtfertigungsdruck zu stehen. Für die nationalen Sozialstaaten ist dies allerdings dann problematisch, wenn der EuGH seine Entscheidungsmacht dazu nutzt, ehemals abgeschlossene nationale Räume sozialer Umverteilung auch gegen die Interessen der Mitgliedstaaten aufzubrechen und einer einheitlichen europäischen Ordnung zu unterstellen. Der Autor des Buches verfolgt das Ziel, sich jenem Spannungsverhältnis zwischen den europäischen Sozialstaaten und dem EuGH unter Zugrundelegung der Theorie des Neo-Institutionalismus zu nähern und das komplexe Entscheidungshandeln des Gerichtshofes sowie dessen deutlich sichtbaren Einfluss anhand von ausgewählten Urteilen zur europäischen Sozialrechtsintegration am Beispiel des deutschen Sozialstaats zu erklären.
