§ 360 Ziffer 13 des Reichsstrafgesetzbuches von 1871 gewährleistete nur unzulänglichen Tierschutz. Die Strafrechtsreform 1909-27 scheiterte an Vivisektion und Schächten. Dem Reichstierschutzgesetz 1933 folgten Nebengesetze 1934-40. Sie bildeten ein Regelungssystem zum Tierschutz. Durch angepasste Auslegung entstand das Tierschutzrecht als Fachgebiet.
