Description
Der ägyptische Jurist Muhammad Qadrî Pâshâ (gestorben 1886) veröffentlichte im Jahre 1875 erstmalig in der islamischen Welt eine nach westlichem Muster erstellte Kodifikation des islamischen Familien-, Personen- und Erbrechts. Aufgrund seiner rechtlichen und sprachlichen Fähigkeiten legte er ein detailliertes Gesetz vor, welches sich ausschließlich an den Bestimmungen der hanafitischen Rechtsschule orientierte. Die Umgestaltung des ägyptischen Gerichtssystems Ende des 19. Jahrhunderts, aber auch der Informationsbedarf europäischer Länder ließen diese Kodifikation zu einer wichtigen Quelle für rechtliche Entscheidungen in Ägypten und im Maschrek, aber auch in Bezug auf Muslime in Europa werden. Bis heute wird der Rechtstext zu Rate gezogen, wenn es um Rechtslücken und rechtliche Interpretationen zum Personalstatut arabischer Länder geht. Zudem diente und dient der Text als Grundlage für derartige Gesetze in vielen islamischen Staaten. Die Übersetzung der Qadrî-Pâshâ-Kodifikation basiert auf der ursprünglichen arabischen Textvorlage.
