Die Arbeit vergleicht die Straftatfolgen im deutschen und koreanischen Strafrecht. Ein solcher Vergleich bietet sich deswegen an, weil das koreanische Strafrecht stark unter deutschem Einfluss steht. Der in der Arbeit vorgenommene Vergleich beschränkt sich aber nicht darauf, in schematischer Weise die Rechtsfolgen nur zu beschreiben und gegenüber zu stellen. Vielmehr unternimmt sie den Versuch, von einem fundamentalen Verständnis des Rechts aus eine Basis zu schaffen, auf die die Rechtsfolgen allgemein zu beziehen und von der aus sie zu begründen sind. Diese Basis wird gebildet von der Einsicht in die allgemein geltende, räumlich oder nationalstaatlich nicht beschränkte Vernunftnatur des Menschen und seiner Freiheit. Das Recht, jede Rechtsfolge und so auch die Straftatfolge muss sich von der Basis aus begründen lassen und dabei insbesondere einbeziehen, dass das Recht gegenseitige Freiheitssphären garantiert. Die Strafe und das strafrechtliche Sanktionensystem müssen daher in einem prinzipienorientierten Begründungszusammenhang entwickelt werden.
