Die Asylrechtsproblematik hat eine europäische Dimension gewonnen. Das Zeitalter nach Schengen und Maastricht ist von den Bemühungen der EU-Mitgliedsstaaten um eine Harmonisierung des Asylrechts gezeichnet. In diesem Kontext erscheint auch die nationale Dimension der Asylfrage in einem anderen Licht. Die Schaffung des Art. 16a GG und der darin enthaltenen Drittstaatenregelung rühren in erster Linie aus der vermeintlichen Unvereinbarkeit des bis 1993 geltenden Asylrechts mit dem der übrigen Vertragsstaaten, da kein anderer Staat eine ähnlich umfassende Asylgewährleistung kenne. Dabei wurde aber häufig übersehen, daß auch andere Länder wie z.B. Italien Flüchtlingen verfassungsrechtlich verankerte Individualrechte auf Asyl einräumen. Hieran anknüpfend sollte diese Untersuchung einen Blick auf die tatsächliche Sicherheit des verfassungsunmittelbaren Drittstaates Italien und die sich hieraus ergebenden rechtlichen Folgerungen werfen. Von Interesse ist der Vergleich mit dem Asylrecht Italiens aber auch im Hinblick darauf, ob die mit der Änderung des Grundgesetzes nach außen getretene tendenzielle Restriktion des Asylverständnisses nach Schengen auch für Italien konstatiert werden kann.
