Description
Die im Europäischen Gemeinschaftsvertrag bestehenden und aus ihm ableitbaren normativen Verknüpfungen von Kapitalverkehrsfreiheit und Währungsunion zeigen, daß Aufgabenbereiche des EG-Rats und der Europäischen Zentralbank an Schnittpunkten teilweise nicht sinnvoll praktikabel, zumindest widersprüchlich sind. Wirtschaftspolitische Entscheidungen des EG-Rates können erhebliche Auswirkungen auf die Wahrung der Preisstabilität - dem Primat der EZB - haben. Hier muß die EZB gegensteuern können. Dazu sind teils die Annahme impliziter Kompetenzen der EZB, teils die Einschränkung des Anwendungsbereiches binnenmarktrechtlicher Normen und generell ein Vorrang der 3. Stufe der EWWU als nächsthöherer Integrationsstufe vor dem Binnenmarkt erforderlich.
