Dieses Buch, das Standardwerk der juristischen Methodenlehre, stellt in einem historisch-kritischen Teil die Entwicklung der Rechtstheorie und der juristischen Methodenlehre in Deutschland in ihren wichtigsten Vertretern seit Savigny dar. Es behandelt sodann die Lehre vom Rechtssatz, die Bildung des rechtlichen Sachverhalts und die hierfür erforderlichen Beurteilungen, die Methoden der Gesetzesauslegung und der richterlichen Rechtsfortbildung, endlich die Begriffs- und Systembildung in der Jurisprudenz. Die jetzt vorliegende 6. Auflage berücksichtigt die seit der Vorauflage erschienene umfangreiche Literatur und nimmt zu ihr Stellung. Weiter werden durch die Überarbeitung ein höheres Maß an Geschlossenheit und Verständlichkeit erreicht. Die Ausführungen werden durch zahlreiche Beispiele aus der Rechtsprechung, vor allem des Bundesgerichtshofes und des Bundesverfassungsgerichts, verständlich und für die Praxis fruchtbar gemacht. Der Autor zeigt, daß die Jurisprudenz Methoden eines "wertorientierten" Denkens entwickelt hat, die es ihr erlauben, auch da, wo notwendig Wertungen in die juristische Beurteilung einfließen, diese wenigstens bis zu einer gewissen Grenze nachvollziehbar und überprüfbar zu machen.
