Das gemeinschaftliche Recht der Beihilfekontrolle überformt in immer stärkerem Maße das deutsche Subventionsrecht. Im Gegenzug wirkt das deutsche Verwaltungsrecht in nicht unerheblichem Maße auf das Europarecht zurück. Besonders deutlich wird diese Wechselwirkung bei der Rücknahme gemeinschaftsrechtswidriger Beihilfen und beim Rechtsschutz für Konkurrenten von Beihilfeempfängern.Die vorliegende Untersuchung zeigt und bewertet die vielfältigen Einwirkungen des EG-Beihilferechts auf das deutsche Verwaltungsverfahrensrecht im Falle der Rückabwicklung von Beihilfeverhältnissen. Der Verfasser arbeitet die Möglichkeiten europarechtskonformer Auslegung des deutschen Rechts, aber auch die Ansatzpunkte für eine gesetzgeberische Reform desselben heraus und fordert nachdrücklich eine noch intensivere Kooperation von Behörden und Gerichten mit den europäischen Institutionen.
