1.1 Problemstellung Die nachfolgende Arbeit beschäftigt sich mit der Verfassung der Gerichte und ihrer Haupttätigkeit, der Rechtsprechung, sowie dem damit zusammenhängen den Bereich des gerichtlichen wie des an seiner Stelle angegebenen anderweitigen Rechtsschutzes in der DDR. allge Dabei besteht, wie bei allen fundamentaleren Gegebenheiten, weder mein noch auch in der DDR eine eindeutige und übereinstimmende Auffassung darüber, was ,Rechtsprechung' im Kern ausmacht, was sie im Vergleich etwa zur Rechtsanwendung durch ein staatliches Verwaltungsorgan, zum Ausspruch l einer Ordnungsstrafe wegen einer Ordnungswidrigkeit , zur Ahndung einer 2 3 Verfehlung durch die Polizei bzw. des Leiters einer Verkaufseinrichtung oder zur Staatlichen Vertragsgerichtsbarkeit und zur internationalen Handelsschieds gerichtsbarkeit konstitutiv unterscheidet. Einigkeit herrscht nur hinsichtlich der formalen Bestimmung von Recht sprechung, daß sie nämlich allein von Gerichten ausgeübt wird und die (Haupt-) Tätigkeit der Gerichte Rechtsprechung ist, also eine ein-eindeutige Zuordnung 4 von Gerichten und Rechtsprechung besteht. Was aber könnte als inhaltliches Kriterium gelten? Sieht man sich die oben aufgeführten, der Rechtsprechung benachbarten Beispiele an, so lassen sich drei Elemente in unterschiedlich häufigem Auftreten und in unterschiedlicher Kom bination herausschälen: 1) Es geht um von der Rechtsordnung zugeschriebenes bestrittene oder un klare Rechte und Pflichten; 2) die Entscheidung darüber ergeht durch unbeteiligte, d. h. das Verfahren nicht selbst in Gang setzende und an seinem Ausgang nicht unmittelbar interessierte Dritte sowie 3) das Ergebnis kann notfalls zwangsweise realisiert werden.
