Ce livre marque une étape supplémentaire dans l'étude des relations entre le pouvoir paternel (devenu autorité parentale depuis la loi du 4 juin 1970) et le pouvoir politique. A partir du XVIème siècle, siècle de l'émergence de l'Etat moderne, jusqu'en 1914, le pouvoir politique renforce la puissance paternelle (Ancien Régime, Consulat) ou au contraire, l'affaiblit (Révolution, IIIème République). On observe cette corrélation entre les pouvoirs paternel et politique, en étudiant non seulement l'histoire des institutions, mais également l'histoire des idées politiques. Ainsi, le pouvoir paternel qui est naturel sert de fondement au pouvoir royal, ce qui permet d'affirmer que la monarchie est conforme au droit naturel et divin. Cette théorie est réfutée par deux courants doctrinaux : le premier courant établit que les pouvoir paternel et politique ont un fondement contractuel ; le deuxième courant affirme que l'autorité paternelle a un fondement naturel et que l'autorité politique a un fondement contractuel. Nous montrerons que la mise en ?uvre de ces théories par les régimes politiques conduit à une intervention du pouvoir politique dans l'exercice de la puissance paternelle.
