Product Description Diskriminierungen im Privatrecht werfen zahlreiche grundrechtsdogmatische Probleme auf, zu deren Bewältigung die klassischen Figuren der mittelbaren Drittwirkung sowie der grundrechtlichen Schutzpflicht bereitstehen. Roman Lehner überprüft deren Tragfähigkeit in Bezug auf das Verhältnis von Freiheits- und Gleichheitsrechten und ordnet die diskriminierungsrelevanten Grundrechte grundsätzlich einer einheitlichen Kategorie legislativer und judikativer Schutzpflichten zu. Dabei liegt der Schwerpunkt der Analyse auf der Untersuchung des Diskriminierungsverbots aus Art. 3 Abs. 3 S. 1 GG im Hinblick auf dessen Schutzpflichtentauglichkeit. Die das allgemeine Zivilrecht betreffenden Regelungen des Allgemeinen Gleichbehandlungsgesetzes werden nach Maßgabe der vom Autor gezogenen dogmatischen Schlüsse und unter Berücksichtigung unions- und völkerrechtlicher Bezüge auf ihre Grundrechtskonformität hin untersucht.
