Description

In "De habitu religionis ad vitam civilem" (Über die Religion im Staat) legt Pufendorf die Grundlagen des neuzeitlichen Verhältnisses von Staat und Religion dar. Er beschreibt hier grundsätzlich und erstmalig das staatskirchenrechtliche Prinzip, dass Religionen innerhalb eines Staates dann zu dulden sind, wenn sie sich dem Staatsrecht unterordnen. Diese Einfügung in den Staat verpflichtet den Staat tendentiell dazu, die legalen Religionen zu tolerieren. Dabei ergibt sich die grundsätzliche Schwierigkeit, wie diese staatsrechtliche Einordnung mit international verfassten Religionsgemeinschaften, vor allen Dingen dem Katholizismus, zu vereinbaren sind. Religionen sind nie nur von dieser Welt- es bleibt immer die Frage, wann der Fall eintritt, dass die Religionsvertreter für sich in Anspruch nehmen, Gott mehr gehorchen zu müssen als den Menschen. Diese noch heute ungelöste Problematik wird in ihrer grundsätzlichen Bedeutung für die Frage von staatlich garantierter Toleranz und deren Rechtsförmigkeit diskutiert.
