DROIT BELGE Le testament est le réceptacle des dernières volontés. Le champ des possibles est vaste avec, d'une part, la multitude de dispositions relatives à la transmission d'un patrimoine et, d'autre part, la profondeur des dispositions personnelles, éducatives et spirituelles. Il s'est d'ailleurs étendu à la suite de la réforme du droit successoral, entrée en vigueur le 1er septembre 2018. La réserve héréditaire n'a plus l'ampleur et la nature qu'on lui connaissait auparavant. La liberté testamentaire est élargie. Cependant, l'exercice de rédaction d'un testament reste délicat et circonstanciel. Délicat, parce qu'au jour où ses dispositions seront lues, le testateur ne sera plus là pour les expliquer. Délicat aussi, parce qu'une seule phrase, un seul mot, peuvent déchirer une famille. Délicat enfin, parce que, malheureusement, la loi connaît des ambiguïtés et certaines zones d'ombres, dans lesquelles certains habiles plaideurs pourraient volontiers s'engouffrer. Circonstanciel, car chaque testateur a sa volonté propre et chaque famille sa singularité. Il serait à la fois vaniteux et fallacieux de prétendre pouvoir, dans un seul ouvrage, embrasser toutes les possibilités et proposer des formules idéales. Cet ouvrage constitue un recueil de formules testamentaires commentées. Les formules sont articulées par thématiques, notamment celles du rapport, de la réserve, de l'usufruit, etc. Il a pour vocation de constituer une source d'inspiration et d'informations. Une base de lancement, en quelque sorte, pour celle ou celui qui se risquera à l'exercice périlleux de la rédaction testamentaire.
