Matière classique entre toutes du droit international, le droit des conflits armés a déjà donné lieu à beaucoup d'ouvrages, mais le temps passe, et le droit évolue. Le présent ouvrage reflète cette évolution. Parmi les problèmes généralement peu abordés figurent le champ d'application du droit des conflits armés et la responsabilité de ses violations. Deux chapitres sont donc entièrement consacrés à ces points et répondent notamment à des questions telles que : quand y a t il conflit armé ? Quand ce conflit est il réputé international ? Quels sont les destinataires du droit des conflits armés ? Comment s'applique t il à des forces multinationales telles que les forces de l'ONU ? Quelles sont les incidences de la jurisprudence des juridictions pénales internationales ? Qui porte la responsabilité des violations de ce droit ? Quelles en sont les implications pénales ? Etc. Les principales règles du droit de Genève (situation des personnes au pouvoir de l'ennemi) et du droit de La Haye (conduite des hostilités) sont, évidemment, exposées. Destiné à un public qui n'est pas nécessairement familier des réalités guerrières, l'ouvrage concilie la rigueur froide de la technique juridique avec une approche humaniste de problèmes fondamentalement inhumains et rappelle au lecteur ce que cache l'exposé clinique du droit des conflits armés à l'aide de témoignages et extraits littéraires insérés à titre de lecture cursive, en contrepoint de l'analyse juridique. C'est dans cette perspective qu'un dernier chapitre, plus inattendu dans ce type d'ouvrage étudie sur un plan socio psychologique les causes des violations du droit des conflits armés, et tente de proposer certains remèdes à un phénomène, hélas, trop fréquent. A l'instar des 5 éditions précédentes, cette 6e édition est une mise à jour de la dernière édition parue. La première édition de cet ouvrage a été couronné du Prix de la Paix 1993 décerné par la Fondation Auschwitz et le Centre de la Paix de la ville d'Anvers ; elle a ensuite obtenu le Prix Paul Reuter 1994 décerné par le Fonds P. Reuter et le CICR. About the Author Professeur émérite de droit international de l’Université libre de Bruxelles (U.L.B.). Depuis 2009, il continue à y enseigner le droit des conflits armés ; il est également membre, depuis 2007, de la Commission internationale d’établissement des faits instituée par l’art. 90 du Premier Protocole additionnel aux Conventions de Genève de 1949.
